These Terms of service (“Terms”) govern your access to and use of heusomstore.com and your purchases from Heusom store, which is operated by MPS CAPITAL GROUP LLC (“we,” “us,” or “our”). By using our store or placing an order, you agree to these Terms. If you do not agree, do not use the store.

1. Eligibility

Our store is offered to customers in the United States. You must be at least 18 years old and able to enter into a binding contract to place an order.

2. Products and supplier

Products are fulfilled by a third party supplier and shipped directly from China. We try to display product descriptions and images accurately, but your screen settings and manufacturing variations may cause the product you receive to differ slightly in appearance from what is shown.

3. Orders and acceptance

Placing an order is an offer to buy. We may accept or decline any order, in whole or in part, including for suspected fraud, pricing or listing errors, or product unavailability. If we decline an order after payment, we will refund the amount paid to your original payment method.

4. Prices and payment

All prices are shown in U.S. dollars (USD). Applicable taxes and shipping charges, if any, are displayed at checkout before you pay. Payments are processed by Shopify and its payment processors. Charges appear on your card statement as heusomstore. You confirm that you are authorized to use the payment method you provide.

5. Shipping and delivery

Processing times, delivery times, separate packages, and customs and import charges are described in our Shipping policy, which forms part of these Terms.

6. Returns and refunds

Refunds are governed by our Return and refund policy, which forms part of these Terms. No physical return of the product is required.

7. Intellectual property

All content on the store, including text, graphics, logos, images, and the Heusom store name, belongs to us or our licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, modify, or create derivative works from this content without our prior written permission. Other names and marks that appear on the store belong to their respective owners.

8. Acceptable use

You agree not to:

Use the store for any unlawful purpose or in violation of these Terms.
Interfere with or disrupt the store, its servers, or its security features.
Attempt to gain unauthorized access to the store or to other users’ information.
Use automated means to access the store, such as bots or scrapers, without our permission.
Submit false or misleading information, or use another person’s payment method without authorization.

9. Communications

By providing your email address, you agree that we may send you messages about your orders. We send marketing emails only as described in our Privacy policy, and you may unsubscribe at any time.

10. Disclaimer of warranties

To the fullest extent permitted by law, the store and all products and content are provided “as is” and “as available.” We disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the store will be uninterrupted or error free. Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you.

11. Limitation of liability

To the fullest extent permitted by law, MPS CAPITAL GROUP LLC and its members, managers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising out of or related to your use of the store or any product. Our total liability for any claim relating to an order will not exceed the amount you paid for that order. Nothing in these Terms limits any right or remedy that cannot be limited under applicable law.

12. Indemnification

You agree to indemnify and hold harmless MPS CAPITAL GROUP LLC and its members, managers, employees, and agents from claims, damages, and expenses, including reasonable attorneys’ fees, arising from your breach of these Terms or your misuse of the store.

13. Governing law and venue

These Terms and any dispute arising out of or relating to them or to your purchases are governed by the laws of the State of Florida, United States, without regard to its conflict of law rules. Before starting any legal proceeding, you agree to first contact us at contact@heusomstore.com and try to resolve the dispute informally. Except where applicable law provides otherwise, any legal action must be brought exclusively in the state or federal courts located in the State of Florida, and you consent to the personal jurisdiction of those courts.

14. Changes to these Terms

We may update these Terms from time to time. The updated version will be posted on this page with a new effective date and applies to orders placed after that date.

15. General provisions

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with our Return and refund policy, Shipping policy, and Privacy policy, are the entire agreement between you and us regarding the store and your purchases.
